Notes on establishing child custody

Parents should know that while establishing custody after a divorce or separation is an integral part of the process, it can also get very complicated. It’s important that each party consult with a good family law attorney to gain fair custody, as one should never assume that his or her ex-spouse will agree to demands, says Texas family law professional Shane Kersh.

Child custody orders detail when a child should be with each parent, including time division for vacations, birthdays, and holidays. An order will likewise specify information on visitation arrangements, even a child’s transportation needs. Since these orders are enforceable, you’ve to develop a good, secure routine for the best interest of your child and not compromise being a good parent despite varying degrees of shared custody.

Keep in mind that until such a point that a custody order is officially in effect, each parent has equal rights to the custody of his or her child. It’s thus imperative that the custody order be immediately filed, as the absence of one will give either parents impunity in taking custody of the child at any point. In other words, child custody orders are crucial in affirming parental rights.

Establishing custody is also a key factor in determining the amount of child support. The court will decide on the appropriate amount of child support each parent will receive or pay, depending on the type of custody each has been granted. All in all, having custody regulations in mind—and in place—will help remove undue stress that comes with post-divorce co-parenting, Atty. Shane Kersh explains.
